On Wednesday November 20th, Anapol Weiss Partner Marni Berger will be presenting at a seminar for the National Bar Institute on best practices for trial lawyers to follow as they review the other side’s insurance information, negotiate with the insurance adjuster, and prepare demand packages.

The seminar will begin with an overview of how counsel can perform insurance policy portfolio reviews. This starts with an understanding of the types of coverage available to the defendant and the pre-suit coverage communications that take place between the insurer and potential defendant, as well as the insurance adjuster’s requirements for timely corresponding with counsel.

Ms. Berger will also discuss tools for finding and maximizing insurance coverage throughout the duration of a case, from the pleading, discovery, and ADR proceeding process through trial. This includes dialogue regarding the priority of coverage where there is more than one insurance policy at play.

Ms. Berger, having experience on both the defense and plaintiff sides, will present on the differing objectives each side brings to negotiations with adjusters. She will discuss practical strategies to bridge these differences, helping to increase the chances of a successful case resolution.

An overview of Pennsylvania’s collateral source rule and the inability to double recover is another topic included in this presentation, along with important case and client considerations for settlement.

The seminar will conclude with a vibrant talk about the basics of bad faith insurance claims in Pennsylvania and how to set up and preserve those claims.
