What is Employment Discrimination?

Employment discrimination is any negative or adverse action by an employer against an employee motivated by that employee’s age, race, health condition, gender, or any other protected class of people.

Employment discrimination is unlawful, and you may be able to bring a suit against your employer for lost wages and other damages.

Title VII of the Civil Rights Act

Title VII of the Civil Rights Act prohibits discrimination by covered employers on the basis of race, color, religion, sex or national origin. The Civil Rights Act of 1964 is a landmark labor and civil rights law, intended to protect employees from discrimination.

The Civil Rights Act explicitly outlaws employment discrimination on the basis of race, color, religion, sex, or national origin. Additionally, on June 15th 2020, the Supreme Court ruled that The Civil Rights Act also outlaws employment discrimination on the basis of sexual orientation and gender identity “on the basis of sex.”

What Are the Different Types of Employment Discrimination?

Discrimination in the workplace can take on many forms. Employees have a right not to be mistreated at work. This can be overt (harassment) or subtle (being treated less favorably). Employees have a right to to receive equal pay for equal work, to expect that their medical information shared with HR is not revealed to anyone else without their permission, and to receive reasonable accommodation in the workplace for religious purposes or due to a medical condition.

Your rights in this country to fair treatment and pay in the workplace are protected by national law.

Classes Protected From Discrimination in the Workplace Include:

  • Race
  • Color
  • Religion
  • Sexual Orientation
  • Gender Identity
  • National Origin
  • Age
  • Disability and Genetic Information

If you have experienced discrimination at work due to your race, color, religion, sexual orientation, gender identity, national origin, age, disability or genetic information, you are a protected class member and may be eligible to file a class action lawsuit.
