Anapol Weiss Files Class Action Lawsuit Against Super73, Inc. On Behalf Of Consumers Misled By False E-Bike Claims

By: Anapol Weiss

Marin County, California, December 10, 2024Anapol Weiss, a nationally recognized law firm for consumer rights advocacy, has filed a class action lawsuit on behalf of plaintiff Hillary Whitman and others similarly affected against electric vehicle manufacturer Super73, Inc. The lawsuit alleges that the company falsely marketed and sold its vehicles as e-bikes under California law, causing harm to thousands of consumers.

According to the lawsuit, Super73 misrepresented that its vehicles are e-bikes under the law, including by labeling them as Class 2 e-bikes, leading consumers to believe they were purchasing e-bikes that did not require a license, registration, or insurance to operate. These vehicles allegedly violate California e-bike regulations due to their ability to reach speeds far exceeding legal limits, effectively making them motorcycles rather than e-bikes under California law.

The lawsuit highlights significant safety concerns tied to Super73’s vehicles, including their prevalence in accidents involving minors. Law enforcement in California has raised alarms about Super73’s vehicles, citing their role in unsafe situations for young riders and communities.

Pat Huyett, a partner at Anapol Weiss and lead attorney in the case, emphasized the far-reaching implications of the lawsuit: “This isn’t about mere technical violations of the law—it’s about public safety, corporate responsibility, and consumer trust. Super73 has placed children and families at unnecessary risk by ignoring California’s e-bike regulations. We are committed to holding them accountable.”

The class action seeks to secure refunds for affected consumers as well as injunctive relief to prevent further sales under misleading claims and to protect public safety through regulatory compliance.
