The judge overseeing the Zantac class action in Philadelphia is married to a partner at Reed Smith, which represents GlaxoSmithKline, a manufacturer of the drug. This clear conflict of interest requires Judge Joshua Roberts of the Philadelphia County Court of Common Pleas recuse himself from the case.
Notwithstanding the obvious conflict, Judge Roberts has not voluntarily recused himself. As a result, Anapol Weiss shareholder Tracy Finken and co-counsel for the plaintiffs, have filed a motion demanding that the judge recuse himself.
